Land titles on 9,000sq miles go for Shs22,000

For an application fee of only Shs22,000, people occupying customary land are to be given free freehold (permanent) land titles under a scheme being piloted in various parts of the country. The scheme is expected to spread countrywide.



The new policy, revealed to Daily Monitor by the State Minister for Lands, Dr Kasirivu Atwooki Kyamanywa, comes at a time when Parliament's committee on Physical Planning and Infrastructure is examining proposed amendments to the 1998 Land Act.



Dr Kasirivu told Daily Monitor in an interview last Tuesday that the move is intended to ensure a systematic demarcation and surveying of land currently under the control of the Uganda Land Commission, whose powers are delegated to district land boards. It will see all sitting tenants receive free titles. The tenants on the land, which is also known as customary land, will only be required to pay an application fee of Shs22,000.



"We plan on systematic demarcation," Dr Kasirivu said, adding: "We will survey and then give them all titles," he said.



The comments come in the wake of similar revelations by technical officers in the Ministry of Lands who told Daily Monitor on Monday that occupants of land on the 9,000sq miles, commonly known as akenda, are free to apply for freehold titles.



Mr Augus Bwiragura, the acting commissioner for Land Administration and Ms Sarah Kulata Basigwa said in separate interviews that the 1995 Constitution granted ownership to tenants on customary land holdings.



This revelation is bound to irk the Buganda Kingdom and areas such as Lango, Acholi and Teso where much of the land is still under customary holding.



Buganda presents a particularly unique challenge because what is known as customary land is also what the kingdom has been claiming as its 9,000 square miles. The Kingdom claims the government has been illegally distributing the land and should revert it to Mengo's control.



Dr Kasirivu said a pilot project has already started in Lukalango Parish in Ntungamo, Bulowaza in Iganga, Bumasikye and Bumbobi in Bunghoko and Kasingo in Kibaale District.



The government took surveyors to these areas, who demarcated the land according to the existing boundaries of the current occupants and issued titles.



The project is set to extend soon to Arua, Nebbi, Lira and Kabarole. What will be spared in Buganda is the land under the mailo system.



"In areas like Buganda, we can only pick on areas where there is what they call public land because mailo land here would be challenging," Dr Kasirivu said. "So we shall be looking at districts like Luweero, Nakasongola and Mubende where there are big chunks of land under customary ownership."



The government, on February 5, tabled the Land (Amendments) Bill 2007 before Parliament amid protests from some sections of society.



A wave of protests, mainly led by Buganda Kingdom, has also been going on in a spirited campaign against the Bill, which the government says is intent on protecting tenants, harmonising landlord-squatter relations and preventing rampant evictions.

It is really very sad. I was born in Buganda and I have lived in Buganda all my life, with my parents. I am now married to a muganda woman and we have one kid. We have never considered relocating to another part of Uganda. We have always got on well with baganda, privately and in business. But now, the atomsphere seems suspiously dangerous. This m7has put us in conflict with baganda. I cannot imagine having to move away from Buganda where I have lived all my life, and to start all over. And that time is coming, considering what m7 is doing with baganda land. Any one can tell that baganda are rightly very furious because of grabbing their land.

You say that you can't imagine moving from Buganda (to your "home area&quot because you were born in Buganda. I was not only born in Buganda but my family has no other place to call "home". My father, grandfather and great grandfather lived on the same kibanja since around 1900, without ever having trouble. Yet in 2002 we broke our backs to buy back the kibanja, for $9,000, after a Munyarwanda in M7's PPU bought the land and threatened to bulldoze our grave site. Even though M7's the land law said that we only had to pay Shs 1,000/= he said, "Go hang!".



I appreciate your fear about being forced to move "to your native home". Me, I already live the reality that my native home is occupied by force and the occupiers are fast making my family internal refugees. We have no other place move to. For that reason, I envy you my friend.

Believe it or not, if there was to erupt a military conflict in Buganda, We (and we are a big group of banyankole), we would side with Buganda. So now it is known. We are a big group in UPDF and PGB and are already passing on information. We know what we are doing. We know that all this mess is caused by one man, putting our children in extreme danger.

You say; "Not all banyankole are against baganda or Buganda..." Who are you fooling? You can't say now that you are not against Baganda or Buganda, because action speaks louder than words. What we heard from the beginning was 'naffe tufuneko obwogyerero' and of coarse you got the bwogyerero you wanted and more.



All the mistreatment in the bush and the intentional killings none of you ever raised a finger, all these 20 some years . And you come out now?



Do you think any blind and deaf person can really believe you?

If there's any of you who don't support the regime you should have come out at the very beginning and at least say ISH!

Museveni Is Baffled By Mutebi’s Firm Position On Buganda Land, Turns To Gutter Tactics



The latest from Museveni’s den is that the Rwandese President of Uganda is genuinely baffled with what to do next after Kabaka Mutebi's firm, logical and dignified Christmas message, instructing Baganda to do whatever they can to protect their land. According to one source in the state house, "Museveni is shocked by the speed and firmness with which Mmengo and Kabaka Mutebi managed to shut down his threats in the letter to Mutebi. He miscalculated that Ssendaula, with support from Nsibambi and Bukenya, would slow things down things and allow him to plot. However, for unclear reasons, Ssendaula took cover and threw the hot potato to the 'radicals' who simply heated it up more and threw it back into Yoweri's lap. Nsibambi and Bukenya could not do much because they are discredited at Mmengo where their clumsy efforts to double-deal did not impress."





Sekanyolya's sources warn though that, even if a little dazed, Museveni is not out at all. Indeed, even before Kabaka Mutebi's tough Christmas message was released he (Museveni) instructed Tamale Mirundi to come with a plan to neutralize Mutebi's "feudalist propaganda". According to the sources, Tamale went into full swing, and already has a series of fake news reports prepared whose sole purpose will be to create confusion ("kavuyo") and, if possible, later on make Kabaka seem unreasonable. "Tamale’s plan, which Museveni fully endorsed, is to ‘demystify’ Kabaka and Mmengo by forcing them to start talking to junior Government officials, compromised religious leaders and vagabonds like Kasirye Ggwanga. For example, they have already planted a “decoy” response to the Kabaka’s position on land in Aga Khan’s Daily Monitor and Museveni’s Bukedde. And it is from a nonde_script_ Japadola man, Dennis Obbo. Similar gutter stories are planned for Museveni’s own New Vision and Bukedde. Again, the _object_ive it to take attention off Museveni’s embarrassing performance against Mutebi and draw Mmengo into arguments with lumpens (bayaaye) like Obbo.”





It remains to be seen if, this time, the more strategic thinkers at Mmengo will prevail so that all Buganda officials refrain from writing responses to Dennis Obbo and other members of Museveni’s Buganda Land Brigade (see “Museveni Ridicules Kabaka Mutebi, Sets Tone For His Buganda Land Brigade Hooligans” post of December 7, 2007). Once again, watch out for more gutter news in Museveni’s and Aga Khan’s new outlets, from Baganda, Ugandans and even foreigners, attacking Mutebi and Baganda on land. The man is absolutely desperate!




Keep your eyes open, the enemy is everywhere. But believe it, it's God's will, that the truth, justice, Buganda -- will previal. And that's for sure.
