Land Bill hollow- VP

THE controversial Land (Amendment) Bill 2007 that is currently before Parliament for scrutiny was hurriedly tabled and contains glaring loopholes which must be addressed before its final legislation, Vice President Gilbert Bukenya has said.



Prof. Bukenya's remarks, the highlight of a Catholic mass celebration over the weekend, come as the most frank reservations to date, against the Bill, from the NRM administration's top leadership.



Speaking in Luganda, Prof Bukenya told worshipers who turned out for service at Rubaga Cathedral on Sunday that the Bill was tabled without following the due process.



"The problem I see with the Land Bill is that we hurriedly drafted it without following proper procedures," Prof. Bukenya said. He, however, did not discuss which procedures were flouted.



The Busiro North MP was reacting to complaints by Kampala Archbishop Cyprian Kizito Lwanga, who criticised the government for ignoring the advice of experts and tabled the Bill without carrying out nationwide consultations.



Lands Minister Daniel Omara Atubo told Daily Monitor yesterday that he would seek audience with the Vice President to "guide me on what he meant by loopholes." Mr Atubo, however, insisted that he couldn't authoritatively comment on the VP's statements because "I am not aware he said such words."



Ethics Minister James Nsaba Buturo, who was until yesterday sitting in for the Minister of the Presidency, said; "Really, I don't know whether he said so, but the official position of the government is what has been presented to Parliament. We are satisfied with what we presented and it is clear that consultations were made. We discussed this matter in several caucuses and amendments were made."



However, Dr Lwanga told his flock that although leaders in the country are not "out rightly" opposed to the Bill, it is necessary that government revisits the Bill to effectively address land problems in the country.



"This has been our stand and we told the Prime Minister [Prof. Apolo Nsibambi] that we support the law that aims at protecting tenants as well as landlords and we think this is what the government wants to achieve. But what we want is to clean it [Bill] to ensure that no one is affected after its enactment," he said.



Much to the delight of the congregation, Prof. Bukenya said he had keenly listened to Dr Lwanga's sermon and concurred with what he said.



"What the Archbishop has said is true. The land Bill has gaps. I have noted down some of the points he has mentioned because a Bill starts like that and becomes law. The government or executive prepares Bills which it thinks will solve the problem, but after preparing it, it must ensure the law is for unity," he said, adding that although he strongly supported the Archbishop's sentiments, "I hope this time newspapers will not put it in their own way."



Bishop Lwanga said no one would bar the clergy from expressing their views on the land reforms, as he picked issue with President Museveni's recent warning to religious leaders against commenting on land issues.



"Land matters affect us all and no one can stop us from expressing our views. I don't speak as Lwanga but on behalf of the people in my faith," he said, adding, "the cardinal sent me to Rome to study law. And according to what I know, all law must be in the interest of the people."



The government tabled the controversial Bill last week amid widespread protests from Buganda Kingdom activists and members of Parliament who wanted it stayed.



Already Mengo, the seat of Buganda's government, has locked horns with the central government over the proposals in the Bill which it claims are designed to grab the kingdom's land. But the central government insists the Bill will help curtail the rampant land evictions in the country.



Other MPs from Acholi, Lango, Teso and Karamoja have since come out to back Buganda's position on the Bill, protesting Clause 32 (b) that attempts to grant courts the power to arbitrate in disputes on customary land.



At yesterday's sitting of the Buganda Lukiiko (Parliament), Kabaka Ronald Mutebi told his subjects that as the Ssabataka (head of landlords), he holds express authority over all land in Buganda.



Commenting on the controversial amendments, Kabaka Mutebi made a passionate plea to his subjects to protect the kingdom's land.



"Each clan owns its inheritance land and we must preserve it for the next generation," he said, adding, "There is no battle we will fail to win as long as we stand together."



Mengo Information Minister Charles Peter Mayiga said Mengo was impressed by Prof. Bukenya's observation.



"His statement is quite fair and we are happy that he has added a boost to our voice," he said on telephone yesterday.



"It is good that one of their own has detected the problem. We have tried to advise them but they have not been listening. And whoever messed up the process as the VP states should explain and also resign," said MP Okello-Okello, chairman of the Acholi Parliamentary Group.
